市地稅稽查局涉外企業(yè)專項(xiàng)檢查年度工作總結(jié) 根據(jù)市局部署安排，市地稅稽查局4至6月份組織檢查人員對(duì)15戶涉外企業(yè)2003年至2023年地方各稅費(fèi)繳納情況開展了專項(xiàng)檢查，根據(jù)企業(yè)實(shí)際情況采取調(diào)帳檢查和實(shí)地檢查相結(jié)合的方式，認(rèn)真詳細(xì)地檢查了企業(yè)的賬簿、憑證、報(bào)表及有關(guān)資料。目前15戶企業(yè)已檢查完畢，共查補(bǔ)稅（費(fèi)）21.89萬元，加處罰款5.42萬元，加收滯納金1.25萬元，合計(jì)28.56萬元（有4戶尚在審理之中）。 一、 主要工作做法 （一） 查前吃透稅收政策4月上旬，國(guó)際稅務(wù)管理科就有關(guān)涉外稅收政策，召集檢查人員進(jìn)行了查前輔導(dǎo)，并提出了嚴(yán)格的要求，通過學(xué)習(xí)，檢查人員吃透了涉外企業(yè)的稅收政策，做到了有的放矢。 （二） 查中宣傳稅收政策 由于涉外企業(yè)大多成立時(shí)很短，加上一部分財(cái)務(wù)人員素質(zhì)不高，對(duì)稅收政策掌握和理解不深，應(yīng)在日常申報(bào)的稅而未申報(bào)。檢查人員問其原因，回答說是不知道要交某種稅，或是說沒人告訴要交某種稅，甚至對(duì)要繳的稅產(chǎn)生疑惑。究其原因是對(duì)稅法知識(shí)不夠了解。檢查人員根據(jù)這種情況，不失時(shí)機(jī)的向納稅人宣傳稅收政策，耐心解釋征稅的依據(jù)和規(guī)定。很多納稅人感慨到，通過這次檢查，學(xué)到了不少稅收知識(shí)，避免了今后不出現(xiàn)或少出現(xiàn)類似的問題。 （三） 查后及時(shí)溝通和交流 大多數(shù)涉外企業(yè)，被查出的稅款，并非主觀故意偷逃稅款，而是上面所說的，對(duì)稅收知識(shí)不清楚不懂所致，他們對(duì)查出的稅款不想因補(bǔ)稅而罰款。很多外商主觀意識(shí)上不想偷稅，更不想在稅收上而受到處罰，一旦受到處罰他們會(huì)責(zé)怪財(cái)務(wù)人員的。所以每查結(jié)一戶，檢查人員都要與企業(yè)的負(fù)責(zé)人和財(cái)務(wù)人員進(jìn)行座談，一是講解稅法的規(guī)定，取得理解，二是給企業(yè)提出加強(qiáng)和改進(jìn)財(cái)務(wù)管理的建議。通過交流溝通，企業(yè)感受到稅務(wù)人員的嚴(yán)格執(zhí)法和真誠(chéng)服務(wù)，不但按規(guī)定補(bǔ)交了稅款和罰款，而且稱贊地稅良好的作風(fēng)形象。 二、發(fā)現(xiàn)主要問題： （一）印花稅申報(bào)不足 在對(duì)涉外企業(yè)地方各稅進(jìn)行檢查時(shí)，發(fā)現(xiàn)涉外企業(yè)在增值稅等大的稅種繳納方面還是足額的，但在地方小稅種繳納方面，尤其是印花稅繳納普遍不夠足額，大部分納稅人僅對(duì)銷售收入這部分分月（季）按購銷合同核定申報(bào)繳納，但在企業(yè)經(jīng)濟(jì)交往中， 經(jīng)常與對(duì)方簽訂的加工承攬、建筑工程、勘察設(shè)計(jì)、財(cái)產(chǎn)租賃、財(cái)產(chǎn)保險(xiǎn)、貨物運(yùn)輸、技術(shù)服務(wù)、借款合同、產(chǎn)權(quán)轉(zhuǎn)移等一些合同或協(xié)議，大多數(shù)企業(yè)財(cái)務(wù)人員對(duì)這些合同或協(xié)議不知道要繳納印花稅，有的企業(yè)在收到實(shí)收資本和增加的資本公積也沒有繳納資金帳簿印花稅，他們?cè)诒徊闀r(shí)都感到很冤枉。有一戶企業(yè)在被查補(bǔ)的印花稅中，僅上述列舉的合同協(xié)議中就有六項(xiàng)未申報(bào)，加上資金帳簿印花稅，共查補(bǔ)補(bǔ)繳了近2.8萬元的印花稅。 （二）個(gè)人所得稅代扣代繳不足 一是少數(shù)企業(yè)對(duì)個(gè)人所得稅扣繳認(rèn)識(shí)不足，認(rèn)為全年平均每月達(dá)不到標(biāo)準(zhǔn)就不扣；二是大多數(shù)企業(yè)對(duì)工資以外的收入部分在計(jì)算個(gè)人所得稅時(shí)不計(jì)入，如用現(xiàn)金發(fā)放的防暑降溫費(fèi)、值班補(bǔ)助費(fèi)、加班費(fèi)等，顯然造成代扣不足；三是少數(shù)財(cái)務(wù)人員對(duì)個(gè)人所得稅政策理解不透，造成少代扣；四是個(gè)別企業(yè)沒有把擔(dān)任董事職務(wù)并且取得年薪的外籍個(gè)人在外國(guó)取的收入合并計(jì)征個(gè)人所得稅;五是個(gè)別企業(yè)代職工繳納的應(yīng)由個(gè)人支付的保險(xiǎn)，未計(jì)入工資薪金所得代扣個(gè)人所得稅；如某公司2023年在管理費(fèi)中支付職工儲(chǔ)金保險(xiǎn)32萬元，造成少扣繳個(gè)人所得稅3.2萬元。 （三）城市房地產(chǎn)稅申報(bào)繳納有不足現(xiàn)象。城市房地產(chǎn)稅是由于企業(yè)計(jì)稅依據(jù)弄錯(cuò)或疏忽漏報(bào)；加上責(zé)任人未及時(shí)宣傳輔導(dǎo)造成少繳納。（四）個(gè)別企業(yè)對(duì)資源稅應(yīng)稅礦產(chǎn)品。例如：黃砂、石子等不能足額代扣代繳。（五）水利基金繳納仍重視不夠。我們?cè)跈z查的15戶企業(yè)中有12戶存在補(bǔ)繳水利基金，尤其是職工個(gè)人水利基金繳納不足，如某公司兩年補(bǔ)繳職工個(gè)人水利基金4000多元。（六）發(fā)票問題。少數(shù)企業(yè)在取得對(duì)方的發(fā)票時(shí)，不能對(duì)稅收政策和發(fā)票管理規(guī)定掌握得很清楚，不能嚴(yán)格把關(guān)發(fā)票，出現(xiàn)收到不符合規(guī)定的發(fā)票入帳，如某企業(yè)進(jìn)行工程發(fā)包，應(yīng)取得建安發(fā)票，卻收到國(guó)稅普票和外地建安發(fā)票，容易造成對(duì)方偷逃稅款。三、幾點(diǎn)建議（一）加強(qiáng)對(duì)涉外企業(yè)的稅法宣傳和輔導(dǎo)尤為重要，企業(yè)對(duì)地稅部門征收的一些地方稅種不是主觀故意不繳，而是對(duì)稅法知識(shí)缺乏了解所致，征管責(zé)任人要常到企業(yè)走走，及時(shí)把稅收政策、容易出現(xiàn)的問題告知納稅人。（二）要注重對(duì)涉外企業(yè)個(gè)人工資以外發(fā)放的現(xiàn)金和實(shí)物的檢查，了解企業(yè)是否將工資以外的發(fā)放給個(gè)人收入部分予以扣繳個(gè)人所得稅；對(duì)擔(dān)任董事職務(wù)并且在本企業(yè)取得工資或年薪的外籍個(gè)人同時(shí)又有來自外國(guó)任職公司的收入部分，要督促其提供在國(guó)外取得的收入和已扣繳個(gè)人所得稅的資料，以便與國(guó)內(nèi)收入合并計(jì)征個(gè)人所得稅。（三）在印花稅征管工作中，由于大多數(shù)納稅人對(duì)印花稅的概念還是不清楚，有的容易忽視，有的認(rèn)為只要是對(duì)方交了，自己就不用交的錯(cuò)誤想法，所以應(yīng)加強(qiáng)對(duì)涉外企業(yè)印花稅的宣傳和管理，每次申報(bào)時(shí)要經(jīng)常提醒和督促。因?yàn)樯嫱馄髽I(yè)的外籍老板大多是講究納稅信譽(yù)度的，他們不想因不懂稅法而受到不應(yīng)有的處罰。（四）要重視城市房地產(chǎn)稅和資源稅，督促企業(yè)按時(shí)足額申報(bào)繳納。（五）要加強(qiáng)企業(yè)取得發(fā)票的審核，督促財(cái)務(wù)嚴(yán)格把關(guān)，從源頭控管，加大處罰力度，防止錯(cuò)用發(fā)票的現(xiàn)象。

3、為貧困山區(qū)孩子捐書活動(dòng)。黨員帶頭，公司員工和辦事處員工積極支持，踴躍參加，捐出了書籍，獻(xiàn)上了愛心?；顒?dòng)共收到各類書籍千余本，還有文具等等，雖然說，捐獻(xiàn)不論多少都表達(dá)了我們的心意，每個(gè)人擁有書籍的情況也各不相同，特別感謝的是周康菊和張紅亞同志，他們分別捐獻(xiàn)了196和157本。這些書籍是捐往貧困山區(qū)學(xué)校為了幫助他們建起或充實(shí)其小小的圖書館的，我們一份小小的愛心，受益的卻可能是數(shù)百個(gè)孩子，這種付出真的很值。
