(一)中國大使館和總領(lǐng)事館不為中國公民辦理協(xié)議離婚。當(dāng)事人均同意離婚,且對財(cái)產(chǎn)、子女撫養(yǎng)等沒有爭議,可以在國內(nèi)原婚姻登記機(jī)關(guān)辦理協(xié)議離婚。

每份文件:12英鎊。

附件:提起離婚訴訟須知(摘要)

根據(jù)我國民訴法的有關(guān)規(guī)定,當(dāng)事人起訴離婚時(shí),必須完備下列手續(xù):

一.訴訟的要求:

1.原、被告的姓名、年齡、民族、籍貫、工作單位及地址、家庭住址。

2.請求事項(xiàng),包括離婚要求、受撫養(yǎng)子女的姓名、年齡、由何方撫養(yǎng)及撫養(yǎng)費(fèi)分擔(dān)的具體金額,對家庭財(cái)產(chǎn)的分割意見并離婚后住房安排的意見等。

(2)婚后夫妻感情發(fā)展變化情況?引起離婚的主要原因及事實(shí)依據(jù)?雙方的經(jīng)濟(jì)收入,有無債僅、債務(wù)?夫妻關(guān)系的現(xiàn)狀?是否進(jìn)行過離婚協(xié)商,夫妻有無和好的可能?等等。

(3)如以前曾提出過離婚訴訟的,應(yīng)寫明何時(shí)起訴于何法院?何時(shí)處理結(jié)束的,處理結(jié)果如何?如有書面結(jié)論的,應(yīng)附判決書、裁定書、調(diào)解書的復(fù)印件。

(4)訴狀須用鋼筆書寫,字跡要清楚,訴狀內(nèi)容不得有謾罵和侮辱對方的言辭,更改處應(yīng)加蓋印章(簽字)。

二.舉證要求,起訴離婚的當(dāng)事人應(yīng)同時(shí)提供下列證據(jù)

1.提供家庭財(cái)產(chǎn)清單,注明財(cái)產(chǎn)的品名和數(shù)量,其中屬男方或女方的婚姻前財(cái)產(chǎn)部分和屬雙方婚后的共同財(cái)產(chǎn)部分應(yīng)予分列,并注明財(cái)產(chǎn)現(xiàn)在何處,對共同財(cái)產(chǎn)如有分割要求,必須加予明確。

如有銀行存款、國庫券等,應(yīng)提供開戶銀行的賬號、種類、金額等有關(guān)證據(jù)。

2.應(yīng)提供結(jié)婚住房的有關(guān)材料,注明是公房還是私房,如系單位自管公房的,應(yīng)提供單位對安置住房的意見。

3.提供其它與本案有關(guān)的證據(jù)材料,或取證線索。

7.授權(quán)委托書受托人的權(quán)限(供參考):代為調(diào)查;提供證據(jù);代為出庭;自行和解;接受調(diào)解;代為承認(rèn)、變更、放棄訴訟請求;提起反訴;提起上訴、申請撤訴;申請執(zhí)行;代為簽署有關(guān)文書;轉(zhuǎn)委托權(quán)等。

8.如離婚當(dāng)事人不能親自到使領(lǐng)館辦理有關(guān)公證手續(xù),有關(guān)法律文書如委托書、起訴狀等,應(yīng)根據(jù)認(rèn)證程序辦理。即文件經(jīng)英國當(dāng)?shù)叵嚓P(guān)部門公證和認(rèn)證后,再送往中國大使館或總領(lǐng)館辦理認(rèn)證。

9.此外,離婚當(dāng)事人也可向居住地的英國法院提出離婚訴訟。

如當(dāng)事人欲回中國結(jié)婚,由英國當(dāng)?shù)胤ㄔ撼鼍叩碾x婚判決書,必須經(jīng)中國中級人民法院裁定承認(rèn)。在送中國裁定前,根據(jù)認(rèn)證程序辦理,該“判決書”應(yīng)先送英國當(dāng)?shù)叵嚓P(guān)部門辦理公證和認(rèn)證后,再送往中國使領(lǐng)館辦理認(rèn)證。

(七)收費(fèi)標(biāo)準(zhǔn)和辦證時(shí)間

每份文件:12英鎊。

* 大使館和總領(lǐng)館僅接受現(xiàn)金或money order,不接受信用卡和個(gè)人支票。

辦證時(shí)間:10個(gè)工作日。

以上說明如有更改,以大使館或總領(lǐng)館解釋為準(zhǔn)。

附件:提起離婚訴訟須知(摘要)

根據(jù)我國民訴法的有關(guān)規(guī)定,當(dāng)事人起訴離婚時(shí),必須完備下列手續(xù):

一.訴訟的要求:

1.原、被告的姓名、年齡、民族、籍貫、工作單位及地址、家庭住址。

2.請求事項(xiàng),包括離婚要求、受撫養(yǎng)子女的姓名、年齡、由何方撫養(yǎng)及撫養(yǎng)費(fèi)分擔(dān)的具體金額,對家庭財(cái)產(chǎn)的分割意見并離婚后住房安排的意見等。

3.要求離婚的事實(shí)和理由(可按下列要點(diǎn)陳述)：

(1)何時(shí)何地相識戀愛?何時(shí)在何機(jī)關(guān)辦理結(jié)婚登記?何時(shí)起共同生活?住在何處?生育子女,包括現(xiàn)有子女的姓名、年齡、生活、學(xué)習(xí)或工作情況。

(2)婚后夫妻感情發(fā)展變化情況?引起離婚的主要原因及事實(shí)依據(jù)?雙方的經(jīng)濟(jì)收入,有無債僅、債務(wù)?夫妻關(guān)系的現(xiàn)狀?是否進(jìn)行過離婚協(xié)商,夫妻有無和好的可能?等等。

(3)如以前曾提出過離婚訴訟的,應(yīng)寫明何時(shí)起訴于何法院?何時(shí)處理結(jié)束的,處理結(jié)果如何?如有書面結(jié)論的,應(yīng)附判決書、裁定書、調(diào)解書的復(fù)印件。

(4)訴狀須用鋼筆書寫,字跡要清楚,訴狀內(nèi)容不得有謾罵和侮辱對方的言辭,更改處應(yīng)加蓋印章(簽字)。

二.舉證要求,起訴離婚的當(dāng)事人應(yīng)同時(shí)提供下列證據(jù)

1.提供家庭財(cái)產(chǎn)清單,注明財(cái)產(chǎn)的品名和數(shù)量,其中屬男方或女方的婚姻前財(cái)產(chǎn)部分和屬雙方婚后的共同財(cái)產(chǎn)部分應(yīng)予分列,并注明財(cái)產(chǎn)現(xiàn)在何處,對共同財(cái)產(chǎn)如有分割要求,必須加予明確。

如有銀行存款、國庫券等,應(yīng)提供開戶銀行的賬號、種類、金額等有關(guān)證據(jù)。

2.應(yīng)提供結(jié)婚住房的有關(guān)材料,注明是公房還是私房,如系單位自管公房的,應(yīng)提供單位對安置住房的意見。

3.提供其它與本案有關(guān)的證據(jù)材料,或取證線索。

4.以上應(yīng)提供的證據(jù)可以是書證、物證(包括照片)證人證言,視聽資料,以及當(dāng)事人的承認(rèn)材料。
